In Tennessee, paternity can be established in one of two ways:

  • Voluntarily: if both the mother and the father agree on the biological relationship of the father, then both parents can sign a "Voluntary Acknowledgement of Paternity" form. This can be done either at a hospital or at a local health department. After signing and notarizing the form, the father will then be declared the legal father of the child.
  • Involuntarily: In cases where the father and mother do not agree on paternity, then a court can order DNA testing to verify paternity. Once the DNA has been tested and the parentage of the father is confirmed, then the court will issue an order to add the father's name to the child's birth certificate.

In cases where the father intentionally avoids testing, the court can impose penalties such as jail time or fines. Tennessee paternity laws also allow the court to declare a man the father by default if he refuses to submit to a DNA test.
